Canada Permanent Residency options for Super Visa holders

Super Visa is a good option for Permanent Residents and Citizens of Canada who are not successful in their Family Sponsorship Canada efforts through the Parents and Grandparents Program. While Super Visa does not offer Family PR for Canada from India it is still a viable option. While your family members are staying with you in Canada on the Super Visa you can still Apply for Canada PR Visa from India for them.

The Grandparents or Parents who arrive in Canada on the Super Visa will possess the status of a Visitor. So they are not entitled to the lawful rights and responsibilities accessible to Permanent Residents. It includes the right to work.

You will have to provide a written invitation letter to your parents or grandparents if you are inviting them to remain with you for an extended duration in Canada. It must be included with the Super Visa application.

The invitation letter is a written commitment that you will be responsible financially for the grandparent or parent you are inviting till they remain in Canada.

Requirements for Super Visa

The Grandparent or Parent has to:

  • Demonstrate that they are the grandparent or parent of a Permanent Resident or Citizen of Canada
  • Get medical insurance from an insurance firm in Canada that has a validity of a minimum of 12 months and offers coverage of at least $100,000 for hospitalization, healthcare, and repatriation
  • Appear for a medical exam

The family member of the Grandparent or Parent in Canada has to:

  • Prove that they are a Permanent Resident or Citizen of Canada
  • Offer the applicant with an invitation letter
  • Prove that their income is higher than a fixed minimum level

The Invitation Letter offers details of the planned visit of the applicant, their grandchild’s or child’s occupation, and financial condition in Canada. Chiefly, the letter includes a written assurance of monetary support for the applicant while they stay in Canada and their signature.

Super Visa Application Process

The application for a Super Visa can be filed online or on paper. In any case, the applicant has to demonstrate that they are the grandparent or parent of a Permanent Resident or Citizen of Canada.

The application must consist of an invitation letter from the applicant’s grandchild or child that specifies the plan for their care. It must also share details of the number of individuals residing in their family in Canada.

The applicants are also required to prove that they possess medical insurance from an insurance firm in Canada that has a validity of a minimum of 12 months. The sponsor has to prove possession of sufficient funds for supporting the applicant’s stay by fulfilling the LICO or Low Income Cut-Off for the size of their family unit.

Extensions for Super Visa

Previously, Super Visa allowed the holders to remain in Canada for a maximum of 2 years at a time. Effective from July 2022, they are now permitted to remain in Canada for a maximum of 5 at a time. They now also have the option to file an application for an extension of 2 years from within Canada.

If you wish to remain in Canada for more than 5 years, you have to file an application for an extension. You must file the application for an extension not beyond thirty days prior to the expiry of the current status.

You can remain in Canada while you wait for the decision on your application even if your existing Visa expires during the processing of your application for extension. It is termed as the ‘implied status’.

The Super Visa is a type of TRV – Temporary Resident Visa. So the Visa holders can stay in Canada only till the Visa remains valid. Note that there is no policy on their stay duration overseas before re-arriving on the Super Visa. However, authentic medical insurance is needed each time they re-enter Canada and this can require some time for processing.

Super Visa Processing Times

The Super Visa processing times differ according to the nation from which the application is submitted. For example, if the application is filed from India, on average 135 days are required for processing the application. It does not include the time for submission of biometrics.

The application processing times will also be influenced by the volume of applications received by IRCC. It also depends on if the application is complete and the ease of verification of the information offered by the applicant. You must ensure to confirm the latest processing times on the IRCC website prior to filing the application.

Super Visa to PR Visa

The Super is a TRV – Temporary Resident Visa and it cannot be converted into a Permanent Resident Visa. However, filing separate PR Visa applications from overseas is allowed. Super Visa only allows the holders to remain in Canada for up to 5 years at a time with the option for extension.

 If Super Visa holders wish to obtain Permanent Resident status, they can consider the PGP – Parents and Grandparents Program under the Family Class Sponsorship Program. PR status will authorize them to remain permanently in Canada and also work in Canada.

Nevertheless, it must be noted that there is an annual quota for the approval of PR Visas under the Family Class Sponsorship Program. The application processing times can extend up to even 2 years or more. Meanwhile, the applicants can stay in Canada on a lawful Super Visa while their PR application is under process.

Remaining in Canada on a Super Visa and getting an extension is an easy option for applicants to remain in Canada with their sponsoring family members. Super Visa is a multiple entry Visa having a validity of up to 10 years. It can be used to remain in Canada on the temporary resident status while continuing in parallel with the efforts to get PR status.
